Terms of Service
PokerSharp is published by Your Custom Web Design Inc. (“we,” “us,” or “our”), an independent developer. Questions about these Terms may be directed to: support@ycwdesign.com
The App contains simulated poker content and is intended solely for users who are 18 years of age or older. By using the App, you represent and warrant that you are at least 18 years old. We reserve the right to terminate access for any user we have reason to believe does not meet this requirement.
PokerSharp is an educational training tool only. The App simulates poker scenarios for the sole purpose of teaching Game Theory Optimal (GTO) poker strategy.
The following apply without exception:
- The App does not involve real money, real wagers, or real prizes of any kind.
- The App does not offer opportunities to win money, property, or anything of real-world value.
- No virtual currency within the App can be redeemed, exchanged, transferred, or converted into real money or goods.
- The App does not facilitate real-time multiplayer gambling of any kind.
- Any simulated chips, scores, or in-app metrics are for training and educational purposes only and have no monetary value.
The free version of the App uses an in-app “chip” counter that meters how many training hands you can play. These chips are granted free (through daily bonuses and optional rewarded ads), cannot be purchased with money, cannot be cashed out or transferred, and have no monetary value whatsoever. They exist solely to pace the free experience.
Nothing in these Terms or within the App should be construed as an endorsement of real-money gambling, and we do not provide gambling services of any kind.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your personal, non-commercial purposes.
You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, disassemble, or decompile the App; (c) sublicense, sell, resell, or otherwise commercially exploit the App; (d) remove or alter any proprietary notices within the App; or (e) use the App for any unlawful purpose.
The App, including its training content, GTO range data, software, design, graphics, and all other materials, is owned by or licensed to us and is protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you. The PokerSharp name, logo, and associated brand elements are proprietary to us. All rights not expressly granted in these Terms are reserved.
You agree not to use the App in any manner that: (a) violates any applicable local, state, national, or international law or regulation; (b) infringes the rights of any third party; (c) attempts to gain unauthorized access to the App or its underlying systems; or (d) introduces malicious code or interferes with the proper functioning of the App.
App Stores. The App is distributed through third-party platforms including Google Play and the Apple App Store. Your use of those platforms is governed by their respective terms of service. We are not responsible for those platforms and have no control over their policies or availability.
Advertising. The free version of the App displays advertisements served by Google AdMob, a Google service. Use of the App while ads are present is subject to Google’s Terms of Service and Privacy Policy insofar as they govern the AdMob software development kit embedded in the App. We do not control the specific ads that AdMob selects, the bidding network that fills inventory, or the destination of any link presented within an ad.
Rewarded ads. The App offers optional opt-in rewarded video ads in exchange for in-app chips (the free version’s hand meter). Participation in rewarded ads is voluntary. Chips granted by a rewarded ad apply only to the device on which the ad was viewed and confer no real-world value or transferable benefit.
Subscription management. The App uses RevenueCat, a third-party subscription-management service, to validate purchases of PokerSharp Pro and track subscription entitlement (see Section 08 and our Privacy Policy).
Optional Cloud Backup (Google Drive). The App offers an optional Cloud Backup feature that stores your hand history and settings in a hidden, app-private folder of your own Google Drive. It is off by default and activates only if you choose to connect a Google account. Where you enable it, your use of Google Sign-In and Google Drive is governed by your own agreement with Google, including Google’s Terms of Service and Privacy Policy. We do not receive, hold, route, or have any means of accessing your backup, and we are not responsible for the availability of, or any loss of data within, your Google account or Google Drive. You remain responsible for maintaining your own copies of anything you care about. Disconnecting or deleting the backup from within the App, or revoking the App’s access from your Google account, ends this arrangement at any time. See our Privacy Policy for the full detail.
No endorsement. The presence of an advertisement within the App is not an endorsement by us of the advertiser, its products, or its services. We are not responsible for the content, claims, accuracy, or business practices of any third-party advertiser, and we are not party to any transaction you may enter into with an advertiser.
Ad-blocking and disablement. We reserve the right to detect, restrict, or terminate access to the App where ad-blocking, ad-spoofing, or other circumvention of the advertising functions is detected. The supported way to remove ads is the PokerSharp Pro subscription described in Section 08.
PokerSharp Pro is an optional, auto-renewing subscription that removes advertising and the chip meter and unlocks additional study features. It is billed entirely through your app store — we never receive or store your payment details.
What Pro includes. An active PokerSharp Pro subscription removes all advertising, removes the chip meter (unlimited training hands), and unlocks Pro-designated features such as X-Ray Replay and the Fold Skipper option. The exact feature set is described in the App at the point of purchase and may evolve over time; material reductions to what an active subscription includes will be communicated in advance.
Billing and price. Pro is offered as a monthly or yearly auto-renewing subscription. All payment is collected by Google Play or the Apple App Store under their terms; current pricing, in your local currency, is always displayed in the App before you confirm a purchase. We never see your payment card or billing details.
Auto-renewal. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Renewal is charged to the same store account used for the original purchase.
Cancellation. You can cancel at any time through your store’s subscription settings (Google Play → Payments & subscriptions → Subscriptions, or Apple Settings → Apple ID → Subscriptions), or via the “Manage Subscription” screen inside the App, which opens the same store controls. Cancelling stops future renewals; you keep Pro until the end of the period you already paid for. Uninstalling the App does not cancel a subscription.
Free trials and offers. If a free trial or introductory offer is presented, its length and terms are shown in the App before you subscribe. Unless you cancel before the trial ends, the subscription converts automatically to the paid price shown at sign-up.
Refunds. Because billing is handled by the platforms, refunds are governed by Google Play’s and Apple’s refund policies and are requested through them. We cannot directly refund a platform-billed purchase, but if you run into trouble, contact us at support@ycwdesign.com and we will help you navigate the process.
Restoring purchases. Pro requires no account. Your entitlement is tied to your store account: on a new device, use the “Restore purchases” option in the App while signed in to the same Google Play or App Store account.
Price changes. If the subscription price changes, the change applies no earlier than your next renewal, and you will be notified in accordance with the platform’s notice requirements, with the opportunity to cancel before the new price takes effect.
PokerSharp provides GTO training content for educational purposes only. We make no guarantee that use of this App will improve your poker performance or produce any specific financial outcome.
Poker involves inherent risk and financial uncertainty. The strategies, ranges, and training scenarios provided through the App are mathematical approximations of game-theory-optimal play and do not account for the full complexity of live play, opponent tendencies, game selection, bankroll management, or other real-world factors that affect results.
You assume all risks associated with your reliance on the App’s content. We expressly disclaim any responsibility for financial losses incurred at the poker table as a result of using, or acting in reliance on, this App.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- ANY WARRANTY THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY GTO STRATEGY, RANGE DATA, OR TRAINING CONTENT WITHIN THE APP.
Poker strategy is inherently probabilistic. GTO approximations are mathematical models, not guarantees of outcome. No poker training tool, including this App, can guarantee improved results at the poker table. You use the App’s strategic content at your own discretion and risk.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL;
- DAMAGES ARISING FROM YOUR RELIANCE ON ANY CONTENT OR STRATEGY WITHIN THE APP;
- DAMAGES RESULTING FROM INTERRUPTION, SUSPENSION, OR TERMINATION OF THE APP;
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WHERE LIABILITY CANNOT BE EXCLUDED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS ($10.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above exclusions and limitations apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless us and our affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices.
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and without liability to you. We also reserve the right to update these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this document. Your continued use of the App following any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
We may suspend or terminate your access to the App at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, the license granted to you under Section 4 will immediately cease. Sections 5, 10, 11, 12, 16, and 17 shall survive termination of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Binding Arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in Texas. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You and we each waive the right to bring or participate in any class action, collective action, or representative proceeding. All claims must be brought solely on an individual basis.
Exceptions. Either party may bring an individual claim in small claims court if the claim qualifies. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to prevent infringement of intellectual property rights or unauthorized use of the App.
Opt-Out. You may opt out of arbitration by notifying us in writing at support@ycwdesign.com within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations freely.
PokerSharp is a skill-training tool, not a gambling platform. However, we recognize that poker is played in real-money contexts and that problem gambling is a serious concern.
